Overview
This website is operated by Gloen LLC ("Gloen", "we", "us" or "our"). By visiting our site and/or purchasing from us, you agree to these Terms of Service ("Terms"), including the policies referenced here: our Return & Refund Policy, Shipping Policy, Privacy Policy and 6-Month Limited Warranty. Please read these Terms carefully. If you don't agree to them, please don't use our site.
Our store is hosted on Shopify, which provides the online platform that allows us to sell our products to you.
1. Eligibility
By agreeing to these Terms, you confirm that you are at least the age of majority in your state of residence, or that you are the age of majority and have given consent for a minor dependent to use this site. You may not use our products or site for any illegal or unauthorized purpose.
2. Products
We make every effort to display our products and their colors as accurately as possible, but we can't guarantee that your screen will show colors exactly. Measurements are approximate.
Our stones are set by hand and each piece is finished individually, so small variations in stones, plating tone and finish are natural and are not defects. Each product page describes the base metal, plating and stones of that piece. Plated jewelry wears gradually with use; following our care instructions helps it last longer.
We may limit the quantities of any product we offer, and we may discontinue any product at any time.
3. Prices & Payment
Prices are listed in U.S. dollars and may change without notice. Applicable sales tax is calculated at checkout. Payments are processed by Shopify Payments and other providers shown at checkout; we don't store your full card details.
Unless stated otherwise, discount codes and promotions can't be combined and have no cash value.
4. Orders
We reserve the right to refuse or cancel any order, including orders that appear to be placed by dealers, resellers or distributors, or that show signs of fraud. If we cancel an order after you've been charged, we'll refund the full amount to your original payment method.
You agree to provide current, complete and accurate purchase and account information, and to update it promptly if it changes.
5. Errors & Omissions
Our site may occasionally contain typographical errors, inaccuracies or omissions in product descriptions, pricing, promotions or availability. We reserve the right to correct any error and to cancel orders affected by it, even after your order has been submitted. If this happens, we'll contact you and refund any amount charged.
6. Shipping, Title & Risk of Loss
We currently ship within the United States only. Title and risk of loss pass to you when we hand your order to the carrier. Shipping times are estimates and are not guaranteed. Our Shipping Policy explains how we handle lost, stolen or damaged packages.
7. Returns & Warranty
Returns and exchanges are governed by our Return & Refund Policy. Manufacturing defects are covered by our 6-Month Limited Warranty.
8. Reviews & Submissions
If you send us comments, reviews, photos or other content, you grant us a non-exclusive, royalty-free right to use, reproduce and publish that content in connection with our store and marketing. You confirm that your content is your own, is accurate, and doesn't violate anyone's rights. We may remove any content at our discretion.
9. Third-Party Tools & Links
Our site may include tools or links provided by third parties. We don't control and aren't responsible for third-party websites, products or services. Your use of them is at your own risk and subject to their own terms.
10. Intellectual Property
All content on this site — including text, photos, graphics, logos and the Gloen name — belongs to Gloen LLC or its licensors and is protected by law. You may not copy or use it for commercial purposes without our written permission.
11. Prohibited Uses
You may not use our site to: break any law; infringe our or anyone else's intellectual property; harass or harm others; submit false or misleading information; upload viruses or malicious code; collect other users' personal information; or interfere with the site's security or operation.
12. Disclaimer & Limitation of Liability
Except as expressly stated in our 6-Month Limited Warranty, our site and products are provided "as is" and "as available". To the fullest extent permitted by law, Gloen LLC and its owners, employees and suppliers will not be liable for any indirect, incidental, special or consequential damages arising from your use of our site or products. Our total liability for any claim will not exceed the amount you paid for the product involved.
Nothing in these Terms limits any rights you have under applicable consumer protection law that can't be waived.
13. Indemnification
You agree to defend and hold harmless Gloen LLC and its owners and employees from any claim or demand arising from your breach of these Terms or your violation of any law or the rights of a third party.
14. Severability & Entire Agreement
If any part of these Terms is found unenforceable, the rest will remain in effect. These Terms and the policies referenced above are the entire agreement between you and Gloen regarding your use of our site.
15. Governing Law
These Terms are governed by the laws of the State of Florida, without regard to its conflict of law rules. Any dispute will be handled in the state or federal courts located in Osceola County, Florida.
16. Changes to These Terms
We may update these Terms at any time by posting the new version on this page. Changes apply to orders placed after they are posted.
